Towns Are Freezing Data Center Permits Over Power Bills and Water

Silicon and substations still matter, but permits to build them are now dying in school gyms over who pays for the next kilowatt-hour and where the water comes from. Builders have the ability to put rooms on a truck in months but hearings still run on weeks of notice that was not publicized.

Taylor Budowich, founder of the Innovation Council, wrote in the Washington Post on September 2 that data center companies lose the town meeting when they talk national strategy to people who want a local ledger. In Richland Parish, Louisiana, Meta's first sales-tax check funded teacher bonuses that reached $50,000. In Ellendale, North Dakota, the town was told household power bills could fall about $250 a year. Those numbers beat a politician's speech about winning an artificial intelligence race with China.

I have been saying a version of that. Most firms building data centers are infrastructure companies. They know how to build but are not staffed for professional external communications. A project stays quiet until a council vote or a land option leaks. Then the town hears that electric rates may go up, and nobody from the company can say what that does to the school budget, the drinking-water well, or the local tax roll.

Gallup's March survey put opposition to a local artificial intelligence data center at 71 percent, including 48 percent strongly opposed, higher than opposition to a nuclear plant in the same poll (Gallup, 2026). Democrats were more likely to be strongly against it. Republicans were still against it. Opponents named water and electricity first. Supporters of data center builds named jobs first.

Construction of a gigawatt campus can put thousands of new jobs on a site for years. After handover the headcount will reduce. Taxes from the building can still help a small county after the construction crews leave. Until data centers in space become reality, these fights will continue.

Skip Early Notice and the Town Can Freeze the Project

Budowich's advice is spot on. Keep it local. Address the bill questions first.

Erin Brockovich opened brockovichdatacenter.com in late April after a cluster of emails from one Louisiana town. The map crashed twice in 72 hours. By late May the site showed more than 2,700 community reports. The count has continued to rise. The United States already has thousands of ordinary data halls. Her map is where people were surprised or angry (Snopes, 2026; Guardian, 2026).

Brockovich says the same story keeps arriving in her inbox. People woke up to construction. The council had already voted. City hall had often signed a nondisclosure agreement with the developer, so residents were not in the room. The emails also mention higher water bills, noise, and wildlife. She compares that to Hinkley, the California groundwater case that made her famous, except now it is happening in many counties at once. The useful fact for a company is simple. In those towns, notice came after the vote.

Local governments have turned that sequence into paper. Electric Choice's tracker listed 321 moratoriums and restrictions recorded since 2024 across 32 states, with 261 in force as of September 1, heavy in New Jersey, Michigan, Ohio, and Georgia (Electric Choice, 2026). Other trackers count higher once townships and expired pauses are swept in. Maine's legislature passed a statewide pause and the governor vetoed it. New York moved a pause on large halls. Michigan towns stacked local freezes after Saline Township's fight. Goldman Sachs has told investors that only 50 to 60 percent of capacity scheduled in the next year or two may arrive on time, below the old hit rate, because delays and cancellations now sit on top of equipment lead times (GlobeSt, 2026).

Who Shows Up at the Hearing

Residents and farm towns ask what the building does to the bill, the well, the night noise, and the road. They live with a load they did not vote on.

Amazon, Microsoft, Google, Meta, Oracle, OpenAI, and xAI need gigawatts on a timeline utilities cannot meet. Hyperscalers put cash into power purchase agreements, fuel cells, gas turbines, nuclear restarts, and batteries. In March they signed a voluntary White House Ratepayer Protection Pledge: bring or buy generation, fund upgrades, keep residential rates off the hook. The pledge is not enforceable. States are writing the same ideas into statutes. Oregon requires a separate rate class above 20 megawatts. Texas Senate Bill 6 covers loads above 75 megawatts and disconnection in grid stress. Alabama requires a ratepayer-benefit test above 150 megawatts. Florida bars utilities from pushing data-center infrastructure costs onto households (MultiState, 2026; ArentFox Schiff, 2026).

Utilities are stuck in the middle. If they hook the campus up on the same rate as everyone else, households think they are subsidizing the tech company. If they refuse, the company builds its own power plant on the site and leaves the utility out. The current workaround is a special contract: a minimum bill so the campus pays its share, and batteries the tenant pays for. That can protect household rates on paper. In a town meeting it still sounds like a private deal.

Unions want the construction jobs. Local business groups want the new tax base. Neighbors who will live next to the building after the crane leaves sit on the other side of the room. Farmers show up when cooling towers would take water that now goes to irrigation. Analysis circulated with the Brockovich coverage said about two-thirds of planned U.S. data centers sit in places already short on water (Guardian, 2026). A closed cooling loop, water reused inside the building, shrinks that fight. An open cooling tower that evaporates town water is the fight.

Washington treats the buildout as a race with China. The Justice Department intervening in the xAI turbine case on defense grounds is the hard version of that argument. Communities hear it as a veto of local process. It will keep arriving wherever a campus trains a model the Pentagon already uses.

Tech companies are not the ones buying the power company. Infrastructure funds are, including vehicles tied to NextEra, Dominion, BlackRock, AES, Constellation, and Calpine. A household in Michigan still gets a bill from DTE. A household in Virginia still gets a bill from Dominion. If that bill goes up, the neighbor does not care who owns the holding company. They care that the new campus next door is the reason everyone is talking about rates.

National Studies Find Small Bill Effects. Town Meetings Run on the Local Rumor.

Households think data centers are why their electric bill went up. A Pew survey found 43 percent called data centers a major reason rates are rising (Pew, via The Verge, 2026). The academic studies do not show a huge national spike. A New Jersey paper found about two dollars a month, then under a dollar after a tighter comparison (New Jersey State Policy Lab, 2026). Other papers blame storms, fuel, and grid upgrades more than new halls (Reuters commentary citing CGEP, 2026; City Journal summary of EPRI, 2026). A few local studies find a small bump, about 1 percent, mostly at co-ops and city utilities (wattsmybill.org, 2026; NCEA, 2026). Ellendale talks about money back to households. AEP Ohio has been used as a large descriptive increase.

A national average hides a Dominion line item in Loudoun County and a rebate in a wind county. Politics runs on the local bill and the rumor of the next one.

Water is easier to measure because it shows up on a meter. Memphis Light, Gas and Water bills for xAI's Colossus campus have been published in local television investigations. In May, Representative Alexandria Ocasio-Cortez brought brown-water jars from Newton County, Georgia, to a House hearing about Meta's Stanton Springs campus. Meta disputes the link and points to a groundwater study it paid for. Construction started first. The complaints followed. Congress came later (Bellamkonda, June 19, 2026).

Construction Is Getting Faster. Approvals Are Taking Longer.

John Keilman and Jemal R. Brinson laid out the construction half of this boom in the Wall Street Journal. A large hall can still take as much as three years. Eliot Ahdoot of Montreal's Hypertec Construction told the paper that falling behind on capacity means falling behind on the model. Jensen Huang said China's building speed is extraordinarily high, helped by power and fewer local stops. Ben Kaplan of Turner said the industry is being reshaped and that Turner's record for putting up a data center is 90 days (Keilman and Brinson, 2026).

The suppliers around that race are selling weeks. Clayco uses ChatGPT to review contracts and vendor packets and claims about five hours back. Amrize models custom concrete mixes instead of trial batches and claims several weeks. PPG's Steelguard 951 fire coating goes on steel in the shop, before the frame goes up, several more weeks. Clayco and Turner's xPL Offsite unit build electrical and mechanical rooms in a factory and truck them to the pad, several months. A DeWalt and August Robotics drill robot sinks thousands of floor anchors for racks, about six weeks. 3M's fiber connectors let a technician seat a server in seconds. The Journal's graphic put that last item at six months of schedule (Keilman and Brinson, 2026).

Those savings help the general contractor. They also mean a factory-built mechanical room can leave the plant while the planning board is still arguing about the well. Construction employment spikes harder and ends sooner. The town that was promised years of payroll watches the crane leave on a 90-day record. Clayco is already in 57 active U.S. data-center jobs and is on the Deep Atomic bid to put a hall next to a small reactor at Idaho National Laboratory (ENR, 2026).

Keilman and Brinson put the other problem on the same page as the robot drill. Investors are asking what the returns are. Towns are passing bans. A faster pour does not lift a moratorium.

Oracle in Michigan Paid for the Batteries So Household Rates Stay Off the Hook

Oracle and OpenAI are building a campus called The Barn in Saline Township, south of Ann Arbor, with Related Digital. Full load is about 1.4 gigawatts on DTE Energy, a single campus DTE has described as about a 25 percent jump in its electric load. The tenant is an Oracle unit called Green Chile Ventures. It pays for battery storage that DTE will own and run. The Michigan Public Service Commission approved a 1,332-megawatt battery portfolio in March, including 332 megawatts tied to this campus. Oracle covers those battery costs over 15 years and keeps wholesale market revenue from the units (Construction Review, 2026).

DTE has said that if the campus comes online by the end of 2027, and if the current rate case comes out the way DTE wants, it will skip new residential rate filings for two years. Michigan Attorney General Dana Nessel called that offer a "ransom note." She said the pause only happens if Saline is approved and the pending rate case goes DTE's way (Michigan Advance, 2026). Oracle and Related point to about $300 million a year in benefit to other DTE customers, because the big new load helps pay the fixed cost of the grid (Related; Oracle; DTE statements, 2026). Cooling is a closed loop. Related has said ongoing water use is about the same as an office building.

That contract is the part other campuses on a public utility should study. The tenant pays for the extra capacity the grid needs. The household is not supposed to pick up that bill. States that now require a separate rate class or a ratepayer-benefit test can use the same idea.

The town process is a different story. Saline's board and planning commission rejected the project. The developer sued. Construction started. Neighboring Michigan towns stacked moratoriums. Environmental groups and the attorney general challenged how fast the commission approved the DTE contracts. In July the township granted a large property-tax abatement. Governor Gretchen Whitmer asked developers to sign a good-behavior pledge. Oracle said it would (State Affairs, 2026; Tom's Hardware, 2026).

Take the Michigan rate contract. Do not take the sequence where the town votes no and construction starts anyway.

I wrote the design half of Oracle's community framework on June 19. Josh Pitcock's January note set four pillars: the company pays for its own energy, it conserves water, it hires locally, and it designs the site so neighbors can live with it. Project Jupiter in Doña Ana County, New Mexico, dropped the original gas-turbine and diesel plan for up to 2.45 gigawatts of Bloom fuel cells after air-quality questions. Vendor figures put the nitrogen-oxide cut at about 92 percent and take water out of generation. The cooling loop is filled once. Michigan was a line on the Stargate map in that piece. It was not yet the battery contract (Bellamkonda, 2026; Oracle and Bloom, 2026).

Fuel cells in New Mexico take a combustion plant off the hearing agenda. Batteries in Michigan keep DTE in the deal and make Oracle pay for peak capacity. Hiring is still the thin page. Oracle talks more than 1,000 permanent jobs per gigawatt campus and tens of thousands in construction. Local-hire percentages for crews already on site are not public. Setbacks, screening, and noise compared with farm work are what neighbors notice first.

Other Campuses Are Using Different Timelines

Richland Parish and Ellendale already showed what a cash number on a flyer can do. Quincy, Washington, has spent data-center tax money on a hospital and schools. Those places put a number a voter can spend in public before opposition organized.

xAI around Memphis put trailer-mounted gas turbines on the site while the utility hookup caught up. SpaceXAI later agreed with Mississippi regulators to pull 69 mobile units by July 2027 and finish a 1.2-gigawatt permitted gas plant. The company also announced a wastewater reuse plant so the campus would stop drawing Memphis aquifer water. That plant slipped while the halls kept buying municipal water (SpaceXAI Memphis update, 2026; FOX13 Memphis, 2026). The computers arrived first. The lawyers and organizers arrived later.

Chevron, Engine No. 1, and GE Vernova have described a gas plant next to a Microsoft campus in Reeves County, Texas, so the load never sits in the public utility queue. Amazon first tried to take power behind the meter at Susquehanna. The Federal Energy Regulatory Commission blocked that over fears other customers would pay. Amazon rebuilt it as a regular retail contract. Entergy with Meta, and NiSource with Google and Amazon, are running the same partner model as DTE. On paper the household is protected. In the hearing someone from the company still has to say, in public, that the neighbor's rate will not move, and then file the numbers.

A University Reactor Powered a Small Rack. It Is Not a Stand-In for Saline.

In April, Elemental Nuclear Energy and the University of Utah's Price College of Engineering said the campus TRIGA research reactor would make electricity for the first time in its fifty-year life and send that power to a small artificial intelligence rack running a live job. Reactor manager Ted Goodell said that, to their knowledge, it would be the first time any U.S. university reactor had produced electricity. Net output is about 2 to 3 kilowatts from roughly 50 kilowatts of pool heat (University of Utah, 2026).

Saline is about half a million times larger. Purdue's PUR-1 reactor is a different campus story. It is the only fully digital Nuclear Regulatory Commission-licensed reactor in the country. This summer engineers used it for remote-control and machine-learning tests. Artificial intelligence is helping run the core. The core is not feeding a data hall (Purdue, 2026).

Crusoe and Aalo plan a 50-megawatt microreactor setup, five 10-megawatt units, behind a containerized hall at Idaho National Laboratory in 2027, with no outside water for the reactor cooling. Microsoft is paying to restart Three Mile Island Unit 1 later this decade. Amazon has put money into X-energy. Deep Fission is selling letters of intent for small reactors in deep shafts. Applied Atomics licensed the old mPower design and talks 2031. Those projects try to take the town well and the household rate off the table someday. They do not replace a 2027 campus that still needs a DTE-style filing this year (Data Center Dynamics, 2026; Data Center Frontier, 2026).

The Staff Is Built for Permits, Not for the County After Opening Day

I made this point in the SLB cooling post on September 1. Northern Virginia still holds more tracked capacity than any other market. The welcome has cooled. QTS and Compass dropped the Prince William Digital Gateway after court losses over notice next to Manassas National Battlefield Park. Loudoun already pulled data centers out of by-right zoning, which means a new hall now needs a special vote. A Virginia Commonwealth University poll in July found 81 percent of registered voters support making data centers offset the load they put on the grid (Bellamkonda, 2026; Virginia Business, 2026).

More than twenty years ago I worked in a Northern Virginia building when a windowless cement hall went up next door. They added a layer of glass so it would look like an office. That was the public-relations job then. Neighbors now hear the fans and read the Dominion statement. A $4.1 billion heat-exchanger purchase only pays if the next campus can still get a permit.

The companies pouring slabs have interconnection lawyers, air-permit consultants, and tax-abatement negotiators. Clayco, Turner, DPR, and Mortenson are staffed to take months out of the schedule. They often do not have a permanent communications lead who treats the county as a customer after the ribbon is cut. Economic-development offices talk in job-years. Neighbors talk in monthly bills. Those languages do not meet unless someone is paid to translate before the factory room leaves the plant.

Four Items to Put in Writing Before Grading Starts

A campus that wants a second site in the same country should put four items in writing, with a company name on them, before the first grading permit.

Who pays for generation and the grid upgrade, in dollars.

How the building is cooled, and whether town drinking water is in the loop on day one and in year five.

What the tax check does in year one and in year ten, after the construction payroll leaves.

Who at the company owns the county hearing after the crane leaves.

Oracle's Michigan filing is the first item in contract form. The June cooling and fuel-cell work is the second. Hiring percentages and a named local owner for year-ten outreach are still the thin pages.

CIO / CTO Viability Question

If you are siting capacity, or buying cloud capacity tied to a new campus, ask for the ratepayer filing and the cooling plan in the same packet as the megawatt date. A trailer-turbine plan and a reuse plant with no pour date is a different packet. The model only runs if the town and the commission let the building finish.
